Usage Terms – DaDesktop Public Cloud

Purpose

The remote desktops provided are solely intended for delivering training courses, consultancy, or recruitment activities.

 

Billing

Non-permitted use

The following activities are prohibited:

  1. Hosting websites or other services
  2. Bitcoin mining
  3. Conducting performance tests

If DaDesktop personnel detect any of these activities, we will terminate the service without delay and no refund will be provided.

 

Guarantee and Service Layer Agreement

DaDesktop assures 95% service availability.

Maintenance, repairs, and upgrades will be carried out outside of the hosted working hours of 8 am to 8 pm local time (the local time of the server’s physical location).

 

Data Safety and Confidentiality

The service is provided as-is; DaDesktop does not guarantee the confidentiality or safety of any data transferred to the desktops. If you require such assurances, please consider using DaDesktop On-Premise instead.

Given that the desktop is primarily intended for training, it is not suitable for handling highly confidential information.

Authentication to the Remote Desktops prioritises convenience over security.

Troubleshooting Recording

Course Desktops (Fresh-start, Trainer and Participants) may be recorded for troubleshooting purposes.

DaDesktop SUPPLIES THE SERVICES “AS IS,” WITH ALL DEFECTS AND AS AVAILABLE. WE AND OUR SUPPLIERS OFFER NO EXPRESS OR IMPLIED WARRANTIES OR ASSURANCES REGARDING THE SERVICES. TO THE FULLEST EXTENT ALLOWED BY LAW, WE AND OUR SUPPLIERS DISCLAIM ANY IMPLIED GUARANTEES OF MERCHANTABILITY, SATISFACTORY QUALITY, ACCURACY, FITNESS FOR A PARTICULAR PURPOSE OR NEED, AND NON-INFRINGEMENT. WE AND OUR SUPPLIERS DO NOT WARRANT THAT OUTCOMES FROM USING THE SERVICES WILL BE EFFECTIVE, RELIABLE, ACCURATE, OR ALIGN WITH YOUR EXPECTATIONS. WE DO NOT PROMISE THAT YOU CAN ACCESS OR USE THE SERVICES (WHETHER DIRECTLY OR THROUGH THIRD-PARTY NETWORKS) AT THE TIMES OR PLACES OF YOUR CHOOSING. NO STATEMENT, ORAL OR WRITTEN, FROM A DaDesktop REPRESENTATIVE SHALL CREATE ANY WARRANTY. YOU MAY POSSESS ADDITIONAL CONSUMER RIGHTS UNDER LOCAL LAWS THAT THIS AGREEMENT CANNOT ALTER. YOUR USE OF THE SERVICES IS AT YOUR OWN RISK.

YOUR ONLY AND EXCLUSIVE RECOURSE FOR ANY DISPUTE WITH US OR OUR SUPPLIERS IS TO CANCEL YOUR ACCOUNT. UNDER NO CIRCUMSTANCES SHALL THE TOTAL LIABILITY OF US, OUR AFFILIATES, AND OUR SUPPLIERS FOR ALL CLAIMS RELATING TO YOUR USE OF THE SERVICES EXCEED THE FEES YOU ACTUALLY PAID, IF ANY, DURING THE TIME THE RELEVANT CLAIMS ORIGINATED. WE, OUR AFFILIATES, AND OUR SUPPLIERS WILL NOT BE RESPONSIBLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING FROM YOUR USE OF, OR INABILITY TO USE, THE SERVICES.
